1. Agreement Overview

These Terms of Service (“Terms”) constitute a legally binding agreement between KrypitalX Exchange Inc. (“KrypitalX”, “we”, “us”, or “our”) and you (“User”, “you”, or “your”).
 By registering, accessing, or using any KrypitalX services, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

2. Eligibility

  • You must be at least 18 years of age to use KrypitalX.

     

  • You must not be a resident of any restricted jurisdiction listed in our compliance policy.

     

  • KrypitalX reserves the right to deny access to users failing KYC or AML checks.

     

3. Services Provided

KrypitalX provides:

  1. A centralized cryptocurrency exchange for buying, selling, and trading digital assets.

     

  2. A payment gateway for accepting and settling cryptocurrency transactions.

     

  3. Additional services, such as staking, APIs, and business solutions.

     

All services are subject to applicable laws and regulatory frameworks.

4. Account Registration & Verification

  • You must register an account using accurate personal details.

     

  • KrypitalX conducts KYC verification under FINTRAC guidelines.

     

  • Accounts found to use false information or violate AML rules may be suspended or terminated.

     

5. User Responsibilities

You agree to:

  • Maintain the confidentiality of your account credentials.

     

  • Use KrypitalX only for lawful purposes.

     

  • Refrain from manipulating markets, conducting fraud, or engaging in illicit activities.

     

  • Promptly report any unauthorized access or security incident.

     

6. Risk Disclosure

Trading digital assets involves significant risk. Prices are volatile and can fluctuate widely.
 KrypitalX does not provide investment advice, and all trades are executed at your own discretion.
 You should not invest funds you cannot afford to lose.

7. Fees

KrypitalX applies transparent fees for trading, deposits, withdrawals, and merchant services.
 All fees are disclosed in the Fees Schedule section on our website and may be updated periodically.

8. Suspension & Termination

KrypitalX reserves the right to:

  • Suspend or close accounts that violate these Terms, AML laws, or regulatory directives.

     

  • Freeze assets under investigation.

     

  • Deny services to any user associated with high-risk or sanctioned jurisdictions.

     

9. Limitation of Liability

KrypitalX will not be liable for:

  • Losses arising from user negligence, unauthorized access, or market volatility.

     

  • Downtime due to maintenance or system upgrades.

     

  • Indirect, incidental, or consequential damages, even if we were advised of the possibility.

     

Our maximum aggregate liability is limited to the fees paid by you in the 90 days preceding the event.

10. Intellectual Property

All website content, trademarks, logos, software, and documentation are the exclusive property of KrypitalX.
 You may not copy, modify, or distribute them without written permission.

11. Governing Law

These Terms are governed by the laws of Canada and the Province of British Columbia.
 Any disputes will be resolved in the competent courts located in Victoria, British Columbia.

12. Amendments

KrypitalX reserves the right to amend these Terms at any time.
 Updated versions will be published on our website with the effective date clearly stated. Continued use constitutes acceptance of changes.
